1. Delivery

1.1. Your photos will be uploaded to an online viewing gallery within 24 hours of your shoot finishing. This gallery allows you to preview low resolution versions of the images in order to select your favourites and discuss with me any issues you may have before retouching.

1.2. Once you have selected and paid for your images, you will receive the high resolution images to download within 7–10 days, usually much sooner.

If there is an urgent need to get your shots sooner than this, please let me know.

1.3. For monologues the video file/take used for your final edit will be decided on the day together. Your edited video files will be delivered via WeTransfer or similar file transfer service.

2. Copyright

2.1. The entire copyright in the pictures is retained by Flashypanda at all times throughout the world. Flashypanda keeps the rights to use any photograph for his own promotion at any time.

2.2. Flashypanda supplies the technical and artistic ability to illustrate an idea photographically, and sells the right to reproduce those pictures in a given context. No property or copyright in any pictures shall pass to the Client.

3. Cancellation Policy & Payment

3.1. £50 non-refundable deposit is required at checkout. The amount due needs to be paid at least 48 hours prior to your scheduled time. Unpaid sessions will be cancelled.

3.2. You can also choose to pay for your session in full at checkout, in which case your £50 non-refundable booking deposit will be included in the price.

3.3. Sessions can be rescheduled free of charge up to 48 hours prior to the date of the booking.

3.4. If you wish to cancel your shoot, you can. Sessions can be cancelled up to 48 hours prior to the date of the booking. £50 booking deposit will not be refunded. Applies to fully priced bookings (including discounted sessions). Any cancellations failing to meet the 48 hour deadline will need to be paid in full.

3.5. Pay What You Can Sessions are fully non-refundable regardless when cancellation takes place.

3.6. If I am no longer able to make your shoot time due to any unforeseen circumstances, I will first try to re-book your shoot at a time which is convenient for you. If this isn’t possible then you will receive a full refund.

4. Pay What You Can Initiative

4.1. All Pay What You Can bookings are non-refundable. Full payment is required to complete your booking.

4.2. Sessions can be rescheduled free of charge up to 48 hours prior to your shoot.

4.3. After submitting the application form, date and time that fits both parties is scheduled via email. The customer will then be booked in and sent an invoice for the value they typed in when filling the form. The customer then has 24 hours to pay to secure their slot. Any unpaid sessions will be cancelled without notice.

5. Lateness

5.1. If you are late more than twenty minutes, and you fail to notify me beforehand, your shoot will be considered cancelled with no refund.

6. Reproduction of Images

6.1. Clients agree to refrain from adding additional filters or applying any additional retouching to the images at all times. I make sure to edit my images to a professional standard and anything other than this would do a disservice to both my work and to you as a performer.

6.2. In the event of, for example but not restricted to, taking a screenshot of an image, removing the watermark and reproducing it in any media or platform the photographer has the right to take required action (for example, to delete the gallery) to protect their work and is not liable to refund the client.

6.3. Reproduction rights are not issued exclusively to the customer except when specifically granted and recorded in writing.

6.4. Images may be Reproduced or used by the Client for self-promotional use by actor/model (or agent, on their behalf) in their capacity as an actor model including web, print, Spotlight, Mandy and other casting directories, agent mail outs and front of house by employers. This Reproduction extends to personal social media profiles including Linkedin/Twitter/Facebook if they support the acting/modelling career. The self-promotional Reproduction permitted in this clause does not include paid-for advertising, eg. endorsements.

6.5. Any Reproduction by editorial placement must be agreed by FlashyPanda.

7. Behaviour

7.1. Please be respectful and courteous at all times. If I feel a client’s behavior is rude or inappropriate, I reserve the right to end the session without a refund and would not release any pictures taken.

8. Liability & Indemnity

8.1. Whilst Flashypanda takes all reasonable care in performing our agreement and achieving a result we are both happy with, I am, to the extent permissible by law, not liable for any loss or damage suffered by you or a third party arising from my work or any reproduction of the images by you.

8.2. The Client agrees to indemnify FlashyPanda in respect of any claims or damages or any costs arising in any manner from the Reproduction without proper reproduction rights of any Image supplied to the Client by FlashyPanda

8.3. If the Images from a Shoot are corrupted or lost FlashyPanda liability will be limited to providing a further Shoot at no charge

8.4. The client understands that the final edits, including any retouched images not purchased by the client can be used to advertise FlashyPanda on all media outlets and social media anywhere in the world.
